Earnest Money — Refunds, Disputes & Deadlines
How the earnest deposit is handled, when it’s refundable, and what happens in a dispute.
Basics
- Paid to the named escrowee (title/attorney/broker) within the stated business days after acceptance.
- Keep the receipt and share with agents/attorneys.
Refundable when
- Buyer cancels properly under a contingency (on time) using valid notice.
- Buyer and seller sign a mutual direction/release.
Disputes
If the parties disagree on who gets the deposit, the escrowee follows the contract’s directions—often holding funds or filing an interpleader so a court decides. Ask your attorney before escalating.
